1. Copyrights for printing.

Concerning us:

We will never use, sell or promote your artwork without your prior written consent.

Concerning you:

We abide by Copyright laws, so please make sure that you own the appropriate rights to all of your uploaded or shared images. We uphold the right to delete any images that may be subject to copyright infringement.

You are not authorized to reproduce or sell any artwork from other artists without prior written consent from the artist(s) or appropriate rights-holder(s).

2. Personal data Back up

If you don’t want us to keep any imagery you share with us on our server, please ask us and we will delete it.

3. Sales Condition

We want happy customers, so we will make sure you are satisfied. If we have any problem with your source file or problem with the production of your artwork itself, we will contact you to make sure we get it right.

4. Commissioned Art

Wisdom Sewell™’s Commissioned Art service enables customers to commission Wisdom Sewell™ to create original art. Wisdom Sewell™ customers will have the opportunity to request a completely new and unique piece or use an existing piece of art as a starting point. These physical pieces will be shipped directly from the artist or artist agent(s) to the customer.

Wisdom Sewell™ Commissioned Art permits you to engage in a direct relationship with Wisdom Sewell™ as an artist.

The following terms govern that relationship:

A customer creates and art commissions proposal which is communicated to a artist through the Wisdom Sewell™ Commissioned Art Commission Request form.
The artist communicates with the customer who has submitted a request and may either ultimately reject or accept a final proposal in the artist’s sole discretion.
If the customer accepts an artist’s final proposal (creating an “Accepted Commission”) the customer will be charged the upfront payment required by the terms of the proposal. Alternatively, a 50/50 deposit/payment may be arranged at the sole discretion of the artist.
The artist will promptly begin work on creating the Accepted Commission in accordance with the proposed timeline, and if the artist has promised the work within a specific amount of time, will adhere to that schedule.
If the Accepted Commission is over $1,500 in value the artist will provide progress reports at least on a bi-weekly basis. Following the specified number of iterations (or fewer in the customer’s discretion) the artist will present a reasonably clear representation of the completed Accepted Commission to record completion before packaging and shipping.
Once the customer has had time to review the Accepted Commission verification, the artist will promptly ship the finished Accepted Commission to the customer. The artist may require the customer to sign for the delivery.
If the Accepted Commission is damaged upon arrival or otherwise does not match the photograph previously sent to the customer, the customer is entitled to seek remedy from the deliverer. In rare instances, mistakes may occur. In such an instance, customer must contact the artist immediately with detailed images and a video documenting the damage or inconsistency and, if warranted, artist will provide reasonable remedy if fault is the result of the artist. Artist may require the customer to return the Accepted Commission to before the refund is made.
Following the completion of the Accepted Commission the customer may leave the artist a review through the Wisdom Sewell™ Commissioned Art service and the artist may respond publicly to any such review.
Copyrights of all artwork, including Commissioned Art, belongs to the artist. Ownership is transferred to the customer upon completion of payment. Artists retain the right to display their copyrighted artwork in their respective portfolios. Copyrighted artwork may not be reproduced, reinterpreted, reprinted, or remade without the express written permission of and proper compensation to the artist.

WisdomSewell.art is a Venue

WisdomSewell.art acts as a venue to allow customers who comply with these Terms and Conditions to commission and purchase original art within a framework provided by Wisdom Sewell™. On occasion, the Site may host guest artists. Wisdom Sewell™ is not directly involved in the transactions between guest artists and customers. As a result, Wisdom Sewell™ has no control over the quality, safety, morality, or legality of any aspect of the items listed, the truth or accuracy of the statements made by artists or customers, or the ability of artists to create the commissioned art.

Consequently, the sale of art on Wisdom Sewell™ Commissioned Art is directly between the artists and the customer, and at no point will Wisdom Sewell™ take possession or have any ownership rights to the artwork of any guest artist that is produced.

Because Wisdom Sewell™ Commissioned Art is merely facilitating a transaction between the guest artist and a customer, Wisdom Sewell™ will not be able to resolve disputes between the artist and a customer except to the extent set forth in these Terms and Conditions.

You agree that wisdomsewell.art is a venue and as such is not responsible or liable for any content, for example, artist profile information, listing information, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted, transmitted or otherwise communicated by artists, customers, or outside parties on through wisdomsewell.art. You use the Wisdom Sewell™ Commissioned Art service at your own risk.

Satisfaction guarantee

Satisfaction Guarantee means we will ensure each piece is inspected against strict quality-assurance guidelines, each order is packaged and shipped with the utmost care, and nothing leaves our studios less than excellently crafted. If not, we will work to solve any issues as quickly as possible. If there are structural damages or defects to your artwork, we’ve partnered with reputable shippers who will work to remedy the situation as your items will be shipped insured. Due to the nature of custom design, reservations, and art creation, we are unable to refund orders as time and materials lost are irreplaceable and generally not recoupable. However, in rare instances where a refund is granted, the refund process will involve the value of any print processing, less any shipping fees, once you return the artwork back to us (within 30 days from receipt of the product, receipt being the date tracking confirmation or other verifiable confirmation is documented, whichever comes first). In such instances, we will refund within 24-48 working hours on the original method of payment.

5. Privacy

We don’t sell your info, we don’t keep credit card information on our servers. And the file(s) you upload or share with us is stored in a secure server. We do not sell or promote any of these files without your consent.

6. Information on the site

We try to make sure to have the most accurate information on the site, If there is a “bug” on our site, something like 1 million prints for 1$, or price discrepancy, we reserve the right to cancel any order if the information on the site is due to an error or a glitch. We will contact you as quickly as possible, however, if this occurs.

The Legal Stuff

1. PRICES: All prices are Firm. The prices displayed do not include taxes. All transportation, insurance, special packing costs and expenses, and all Federal, provincial and local excise, duties, sales, and other similar taxes are the responsibility of the Purchaser.

2. PAYMENT: Terms are prepayment unless otherwise agreed in writing. Interest shall be charged on overdue accounts at the rate of 36% per annum (3% per month) from the due date.

3. DELIVERY: Purchaser shall supply shipping instructions with each order. (Ship to and bill to address). In the absence of specific instructions, Wisdom Sewell™ may select a carrier and insure Products in transit and charge Purchaser accordingly. Wisdom Sewell™ shall not be responsible for any failure to perform due to unforeseen circumstances or causes beyond its ability to reasonably control. Risk of loss, damage, or destruction is the responsibility of the Purchaser upon delivery to the carrier. Goods are provided solely for incorporation into the Purchaser’s end product and shall not be onward delivered except as incorporated in the Purchaser’s end product.

4. COPYRIGHT: The Services may contain information, graphics, photos, or other materials (“Content”), including Content created with or submitted to the Services by you or through your Artist Account (“Your Content”). We take no responsibility for and we do not expressly or implicitly endorse any of Your Content.

By submitting Your Content to the Services, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms. Because you alone are responsible for Your Content, you may expose yourself to liability if you post or share Content without all necessary rights.

Any ideas, suggestions, and feedback about Wisdom Sewell™ or our Services that you provide to us are entirely voluntary, and you agree that Wisdom Sewell™ may use such ideas, suggestions, and feedback without compensation or obligation to you.

Although we have no obligation to screen, edit, or monitor Your Content, we may, in our sole discretion, delete or remove Your Content at any time and for any reason, including for a violation of these Terms, a violation of our Content Policy, or if you otherwise create liability for us.

5. GENERAL PROVISIONS: All Orders are subject to approval and acceptance by Wisdom Sewell™. Any Order or other form from the Purchaser, which purports to expand, alter, or amend these terms and conditions is expressly rejected and is and shall not become a part of any agreement between Wisdom Sewell™ and the Purchaser. This agreement shall be interpreted under the laws of the State of Georgia, United States of America.

6. LIMITED WARRANTY AND LIABILITY: Warranty Period: Canvas Print – 30 days;. Wisdom Sewell™ warrants that during the Warranty Period that (a) the Product will be free from defects in material and workmanship and conform to specifications; . THESE WARRANTIES ARE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SHALL IN NO EVENT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE DUE TO ANY CAUSE.

Purchaser’s exclusive remedy for a claim under this warranty shall be limited to the repair or replacement at Wisdom Sewell™’s option, of defective or non-conforming materials, parts or components or in the case of software, provision of a software revision for implementation by the Buyer. All material returned under warranty shall be returned to Wisdom Sewell™ prepaid by the Buyer and returned to the Buyer, prepaid by Wisdom Sewell™’s specifications, or failure to follow prescribed installation, operating and maintenance procedures, (ii) defects, errors or nonconformities in the Products due to modifications, alterations, additions or changes not made in accordance with Wisdom Sewell™. Information on the site Wisdom Sewell™’s specifications or authorized by Wisdom Sewell™, (iii) normal wear and tear, (iv) damage caused by force majeure or act of any third person, (v) shipping damage, (vi) service or repair of Product by the Purchaser without prior written consent from Wisdom Sewell™, (vii) Products designated by Wisdom Sewell™ as beta site test samples, experimental, developmental, preproduction, sample, commissioned, incomplete or out of specification Products, (viii) returned Products if the original identification marks have been removed or altered or (ix) Services or research activities.

7. EXCLUSION OF LIABILITY: If a Party would, but for this paragraph (7), have concurrent claims in contract and tort (including negligence) such claims in tort (including negligence) shall to the extent permitted by law be wholly barred, unenforceable and excluded.

Wisdom Sewell™ shall not be liable to the Buyer by way of indemnity or by reason of any breach of the Order or of statutory duty or by reason of tort (including but not limited to negligence) for any loss of profit, loss of use, loss of production, loss of contracts or for any financing costs or for any indirect or consequential damage whatsoever that may be suffered by the Buyer.

In the event and to the extent that Wisdom Sewell™ shall have any liability to Buyer pursuant to the terms of the Order, Wisdom Sewell™ shall be liable to Buyer only for those damages which have been foreseen or might have reasonably been foreseen on the date of effectivity of the Order and which are solely an immediate and direct result of any act or omission of Wisdom Sewell™ in performing the work or any portion thereof under the Order and which are not in the aggregate in excess of ten (10%) percent of the total Order price.
